Through the instant petition, as instituted under Section 482 of the Cr.P.C., the petitioner seeks issuance of directions upon the respondents No.2 to 5 to transfer the investigation of case FIR No.399 dated 21.12.2023, under Section 58 of the N.D.P.S. Act, 1985, registered at P.S. City Kapurthala, District Kapurthala, to the respondent No.1-C.B.I. 2.

On 01.08.2024, this Court had passed the following order:- "1. The learned State counsel submits that they need 15 days' time to take all necessary actions/corrective measures and to file a detailed status report, on affidavit of a responsible functionary, with regard to the investigation, as conducted uptil now in the present matter.

2. Request allowed.

3. List on 23.08.2024, at top of the urgent list.

4. It is clarified that the status report shall be filed three days prior to the subsequent date of hearing and an advance copy thereof shall also be supplied to the opposite counsel."

In deference to the order extracted hereinabove, the learned State counsel has filed a detailed status report, on affidavit of Vatsala Gupta, IPS, Senior Superintendent of Police, Kapurthala, Punjab-cum-Member, S.I.T., which is taken on record.

A perusal of the status report reveals that, all the accused persons, except one Harjant Singh, who has been granted the relief of anticipatory bail, have been arrested. What further erupts from a perusal of the status report is that, during the course of investigation, the relevant provisions of the Indian Penal Code, 1860, have also been incorporated in the present FIR. Not only this, departmental proceedings have also been initiated against the delinquent official(s)/officer(s) concerned. 5.

This Court has perused the status report and is satisfied with the pace and direction of the investigation. Therefore, no further direction is required to be made at this stage. Accordingly, the instant petition is closed. However, liberty is reserved to the petitioner to, in case he has any grievance with regard to investigation, approach the learned trial Court/Magistrate concerned for its redressal.

Moreover, it is also expected that the investigating agency shall expeditiously complete the investigation, preferably within three months from today.

Disposed of accordingly.
