2nd respondent has not been served but the counsel says that he resides at the same address but he is not getting served. I asked the counsel to explain the basis for the civil revision. According to him, the Court fee was not paid at the time of preferring the appeal and hence the appeal was dismissed. Having regard to the nature of the order passed, I dispense with notice to respondent No.2 for consideration of the case. The case has not been disposed of on merits. If the Court fee has not been paid, it will be only appropriate that the time is given to enable the Court fee to be paid. The counsel appearing for the petitioner states that he will pay the Court fee if time is prescribed the Court.
The Court fee shall be paid within a period of two weeks from today and if the same is presented before the Lower Appellate court, the same will be received and the appeal will be admitted to file. The order passed already is modified and the civil revision petition is allowed on the above directions.
