(Oral) By way of present petition filed under Section 439 Cr.P.C., the petitioner prays for grant of regular bail in case FIR No.115, dated 01.12.2022, under Sections 420, 465, 467, 468, 471 and 120-B IPC, Police Station Sadar Pathankot, District Pathankot, during the pendency of trial. Learned counsel for the petitioner submits that the petitioner is a young boy of 23 years of age and the entire case revolves around the documentary evidence, which he has provided to the investigating agency and nothing remains to be investigated qua him and thus, keeping in view the fact that he is behind the bars since 01.12.2022 i.e. for almost two months now, he should be granted bail pending trial. On the other hand, prayer made in the present petition has been opposed at the instance of learned State counsel while submitting that investigation in the present case has not been completed so far and few SONIKA 2023.02.06 18:20 I attest to the accuracy and authenticity of this document
CRM-M-5086-2023 --2-- others, who are allegedly involved in the present case, are at large. I have heard learned counsel for the parties and gone through the paper book. I find substance in the submissions made on behalf of the petitioner.
The petitioner happens to be a young boy of 23 years of age having allegedly submitted certain forged certificates to the institute for the purpose of verification so as to visit abroad. The entire investigation is based on documentary evidence, which has already been handed over by the petitioner to the investigating agency.
Considering the age of the petitioner as well as the fact that he is in custody since 01.12.2022 i.e. for the last more than two months, his incarceration cannot be extended merely on the ground that the few others allegedly involved in this very offence, are at large In view of the above, without commenting anything on the merits, the present petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the concerned learned trial Court/Duty Magistrate. 06.02.2023 (HARKESH MANUJA) sonika JUDGE Whether speaking/reasoned:
