Mr. S.K. Saini, Advocate, for the petitioner. *** Ritu Bahri, J. (Oral) By way of filing the present writ petition, petitioner is seeking direction to respondent No. 3 to change his date of birth as per his birth certificate (P-4) and not to retire him from service on 30.04.2021. Petitioner was appointed as Labour/Work at Sugar Mill Shahabad Ltd, District Kurukshetra, Haryana in the year 1986 on contract basis and after two years, on 02.11.1988, his services had been regularized. The petitioner is now going to retire on 30.04.2021 and is now seeking change of his date of birth after a gap of almost 34 years. Learned counsel submits that petitioner has served legal notice dated 24.12.2020 (P-1) to the respondents and reply has also been given by the respondents on 06.01.

2021 (P-2) that the date of birth of the petitioner has been recorded as 15.04.1961 in the service record. Now at the fag end of the service, the date of birth cannot be changed. The petitioner has given his duly signed application dated 08.08.1988 vide which he requested to appoint him in Sugar Mill. Along with said application, he had also attached his Bio Data, affidavit in which he has mentioned his date of birth as GAURAV ARORA 2021.02.16 14:21 I attest to the accuracy and integrity of this document Chandigarh 15.04.1961.

CWP No. 3339-2021 After going through the reply dated 06.01.2021 (P-2), at this stage no ground is made out for giving direction to respondent No. 3 to change the date of birth of the petitioner as per his birth certificate (P-4), as the petitioner is due to retire on 30.04.2021 and the petitioner is at the fag end of his carrer.

No merits.

Dismissed.
