***** RAJAN GUPTA , J. (Oral) Petitioner has sought a direction to grant emergency parole for a period of four weeks to attend the marriage of his sister's son at Town Hathin District Palwal.
Learned State counsel seeks to place on record reply on behalf of respondents No.1 to 4. Prayer is accepted. Reply is taken on record. Learned State counsel has referred to the same and submits that the petitioner is a hardcore criminal. Apart from the case under Section 302 IPC in which he has been convicted, he is on bail in two other cases i.e. FIR No.239 of 2016 under Sections 42 of Prisons Act registered at Police Station Bhondsi and FIR No. 172 dated 21.07.2017 under Section 42 Prisons Act registered at Police Station Baldev Nagar, Ambala. He further submits that Director General of Police, Haryana, has passed a specific order for shifting the petitioner to Disrict Jail, Jhajjar as he fought with prisoners in Ambala as well as with other inmates in Ambala Jail and he was punished on four occasions. given in Para 3 of the affidavit of Anil Kumar, Deputy Superintendent, District Prison, Jhajjar. It has been mentioned therein that on 11.07.2019, petitioner/convict alongwith 41 members of Bhupi Rana Gang quarreled with members of Laurence Gang at Central Jail, Ambala. Alarm was raised in this emergency situation and petitioner was punished for jail offence. It was directed that he be kept under strict watch under Punjab Jail Manual Para No.399(3) by the Superintendent Jail, Central Jail, Amabla. Keeping in view the facts and circumstances of the case, we are of the considered view that petitioner is not entitled to be released on parole for the purpose of attending the marriage of his sister's son.
