Jaswant Singh,J.(Oral) Judgment Debtor is in revision aggrieved by the order dated 29.11.2014 passed by Additional Civil Judge (Senior Division)Tohana whereby the execution application for execution of a money decree was ordered to be dismissed being satisfied after confirmation of the sale by auction and the Judgment Debtor/petitioner granted liberty to withdraw the remaining amount.

At the time of hearing learned counsel for the petitioner very fairly states that the grounds raised in the present revision were available, if at all, to the Judgment Debtor prior to the finalization of the auction and therefore petition being misconceived, prays for permission to withdraw the revision petition subject to payment of any reasonable costs.

In view of the above, present revision petition is dismissed as withdrawn with costs of Rs.5000/- (Rupees five thousand only) to be RAJINDER PRASHAD JOSHI 2015.02.12 12:02 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CR 8823/2014 deposited with District Legal Service Authority,Fatehabad within 30 days from today failing which the costs shall be doubled and recoverable as arrears of land revenue.
