*** Ritu Bahri, J. (Oral) By way of filing present writ petition, petitioner is seeking issuance of direction to the respondents to exempt the probation period of the petitioner as he is already working on the same job since the year 2010. The petitioner was appointed as Fireman on 29.10.2010 on work charge/daily wage basis and remained continue in service with short time breaks in the service. On the basis of notification dated 24.12.2016, the services of the petitioner was regularized. However, respondent No. 3 has put condition No. 2 in the appointment letter fixing the probation period of three years, whereas in the case of similarly situated employees, the probation period has been fixed as two years. Petitioner has completed about 04 years of regular service but till today, respondent No.
2 is paying only basic pay to the petitioner. Learned counsel submits that similar situated employees who are working as Safai Sewak have approached this Court by way of filing CWP No. 1413-2021and this Court disposed of the writ petition on 22.01.2021 giving direction to the respondents to pass GAURAV ARORA 2021.02.

In this regard, petitioner had also given his detailed representation dated 18.11.2020 (P-4) but no action has been taken till date. Without expressing any opinion on the merits of the case, the present petition stands disposed of by giving direction to respondent No 3 to pass speaking order on the representation dated 18.11.2020 (P-3), within a period of three months, from the date of receipt of certified copy of this order.
