The present revision petition has been filed challenging the order dated 02.01.2024, whereby the evidence of the petitioner has been closed as he failed to conclude his evidence. 2.
Learned counsel for the petitioner would contend that given one effective opportunity, the petitioner would conclude his entire evidence at his own risk and responsibility.

Mr. Davinder Singh Saini, Advocate has put in appearance on behalf of the respondent. Learned counsel for the respondent has pointed out that despite numerous opportunities, evidence was not concluded and hence the order cannot be faulted with.

In the present case, though the petitioner has been remiss in concluding his evidence, however, in the interest of justice, this Court deems Ankur Goyal 2024.02.14 10:44 I attest to the accuracy and integrity of this order/judgment
2024:PHHC:020409 --2-- it fit to grant one effective opportunity to the petitioner to conclude his evidence at his own risk and responsibility subject to payment of Rs.10,000/- as costs to be paid to the respondent. The payment of costs shall be a condition precedent.

In view of the above, the present revision petition is disposed off. Pending applications, if any, also stand disposed off.
