ANIL KSHETARPAL, J (Oral) It is not in dispute that the first appeal filed by the petitioner is pending before the appellate Court. It is the contention of the petitioner that learned first appellate court has ordered status quo, which is continuing. Through this revision petition, petitioner alleges that the learned Executing Court is proceeding with execution petition, in violation of the order passed by the learned first appellate Court.
At this stage, learned counsel for the petitioner has submitted that the learned first appellate Court be directed to decide the first appeal, which is pending for 22.02.2018.
Taking into consideration that the appeal is arising out of a suit for specific performance and is pending for the last more than 3 years, therefore, the learned first appellate Court is requested to decide the first appeal on the next date of hearing i.e. 22.02.2018 or within 10 days thereafter. Civil revision stands disposed of accordingly.
