Jaswant Singh,J.(Oral) Defendant-Satbir alongwith his two defendants sons are in revision aggrieved against the order dated 20.11.2014 (P-5) passed by learned Additional Civil Judge (Senior Division) Pataudi whereby on the application of the respondent/plaintiff under Order 32 Rule 3 CPC for appointing ad-litum guardian of defendants 2 and 3, defendant no.1-father has been appointed as guardian.
It is apparent that the agreement to sell dated 24.8.2005 was executed by defendant father on behalf of his minor sons as well and in the suit for possession by way of specific performance they have filed a joint written statement. Defendant father has vigilantly protected the interests of the minors. It is further noticed that there is no adverse interest of defendant father qua the interests of defendants sons.
