Prayer in the present civil writ petition under Article 226/227 of the Constitution of India, is for issuance of an appropriate writ, direction or order in the nature of mandamus directing the respondents to grant the retiral benefits to the petitioner i.e. pension, commuted pension, gratuity and balance Contributory Provident Fund, which have not been released to the petitioner despite having voluntarily retired on 30.11.2018. Learned counsel for the petitioner would contend that in this regard a legal notice dated 25.12.2020 (Annexure P-3) has also been sent, on which no action has been taken so far. He would further contend that at this stage the petitioner would be satisfied if a direction is issued to the respondents to decide his legal notice dated 25.12.2020 (Annexure P-3) in a time-bound manner.

She, on instructions from Ms. Rupinderjeet Kaur, BDPO, Pakhowal, states that as soon as the amounts are received in the account of BDPO, Pakhowal, the same would be released to the petitioner. Heard learned counsel for the parties.

In view of the limited prayer made by learned counsel for the petitioner, the present writ petition is disposed off, without commenting upon the merits of the case, with a direction to the respondents to decide the legal notice dated 25.12.2020 (Annexure P-3) in accordance with law as expeditiously as possible preferably within a period of one month from the date of receipt of certified copy of this order and in case the petitioner is found entitled to the claimed amount, the same be released within one month thereafter.

Disposed off.
