R.P. Nagrath, J. (Oral) After arguing for sometime learned counsel for both the parties have made submissions that the instant petition may be disposed of with a direction to the trial Court to dispose of the suit expeditiously.

When the instant petition was listed on 05.02.2014, this Court had directed that operation of the order dated 06.01.2014 passed by the Appellate Court would be stayed till further orders and that would result in the revival of the order dated 25.07.2013, passed by the trial Court and was to remain in operation till further orders. The instant petition is disposed of with a direction to the trial Court to dispose of the suit expeditiously but preferably within a period of ten months. The trial Court would grant a period of four months each to the rival party to produce their respective evidence. The period of four months in the case of plaintiff(s) would commence from the date already fixed before the trial Court. CR No. 901 of 2014 --2 that during pendency of the suit the order dated 05.02.2014 passed by this Court would continue to operate but it is directed that both the parties shall not raise any further construction over the property in question. The observations made by the Courts below or in the order dated 05.02.2014 passed by this Court and this order would not have any bearing on the merits of the case.
