Appellant who is complainant aggrieved by acquittal of accused/ respondent vide judgment dated 09.11.2010 passed by the trial Court concerned, had come up before this Court in appeal.

Counsel for the appellant submits that it has come on record that the appellant has expired during the pendency of the appeal and his legal representatives are not approaching him to contest or not to contest the appeal. He further submits that the present appeal be disposed of with liberty to legal representatives to revive the same within a reasonable time if they want to contest the same. 3.

Given above, the present appeal is disposed of. As the appellant has expired, liberty reserved to the legal heirs of the appellant to get the appeal revived if they want to contest the same within a reasonable time preferably within six months by explaining the delay.
