*** HARSH BUNGER, J. (Oral) The instant Writ Petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Certiorari for quashing the order dated 09.12.2024 and 10.12.2024 (Annexures P-1 and P-2) passed by the learned Lokpal, MGNREGA, District Rural Development Agency (DRDA), Nuh. 2.

On advance service of copy of petition, Ms. Upasana Dhawan, AAG, Haryana, appears on behalf of the respondent(s)-State. 3.

Learned State counsel on instructions from Mr. Varun Sharma, Assistant Project Officer, DRDA, Nuh, informs the Court that the order passed by the learned Lokpal, MGNREGA has been passed under the Mahatma Gandhi National Rural Employment Guarantee Act (MGNREGA), 2005, whereunder remedy of appeal is provided to the Appellate Authority consisting of an academician, a retired civil servant and a civil society representative.

CWP-2305-2025 (O&M) -23.1 It is further submitted by learned State counsel that since the constitution of the Appellate Authority is under process by the State Government, till then, an aggrieved person can avail his remedy of appeal before the learned Commissioner, MGNREGA, Rural Development Department, Haryana.

Learned counsel for the petitioners, in view of the aforesaid stand taken by learned State counsel, submits that he may be permitted to withdraw the instant writ petition at this stage with liberty to the petitioners to avail their remedies of appeal before the Appellate Authority as stated by the learned State counsel.

In view of the above, the present writ petition is dismissed as withdrawn at this stage with the liberty aforesaid. 6.
