The correctness of the interlocutory order passed by the trial Court while extending the period for deposit of the ad valorem court fee has been challenged.

The petitioner herein is the defendant in the suit filed by the plaintiff under Section 6 of the Specific Relief Act, 1963. The learned counsel representing the petitioner submits that the suit filed by the plaintiffs has already been dismissed in default but an application for restoration of the suit is pending.

The trial court has exercised its discretion while granting additional time to the plaintiffs for making good the deficiency in payment of the Court fee for the reasons stated in the application. Civil Revision No. 851 of 2019 Court does not find it appropriate to interfere in the exercise of its revisional jurisdiction.

Keeping in view the aforesaid facts, no ground is made out to interfere with the impugned order. Hence, the present revision petition is dismissed.
