Dated Police Station Sections 23.05.2020 Model Town, District 21(1) of Mines and Minerals Hoshiarpur Act 1957 Seeking quashing of the order dated 22.12.2023 (P-4) passed by the Additional Sessions Judge, Hoshiarpur, wherein the application filed by the petitioner for furnishing bail bonds in the FIR captioned above, was dismissed, petitioner has come up before this Court by filing the present petition under Section 482 CrPC. 2.
On 23.04.2024, Coordinate Bench of this Court observed as under:- ".......In light of the above, taking a lenient view, the order dated 22.12.2023 (Anexure P-4) is kept in abeyance and the petitioner is granted liberty to furnish the bail bonds in the compliance of the order dated 29.05.2020 within two weeks from today. However, the same shall be subject to deposit of cost of Rs.5,000/- by the petitioner in the Nishkam Sewa Group (run by Punjab & Haryana High Court Lawyers at Chandigarh)."

Short reply on behalf of the State has been handed over in the Court and the same is taken on record.

Petitioner was released on bail during pendency and after that he was asked to furnish bonds and when petitioner failed to furnish bonds, trial Court cancelled his bail and prayer for acceptance of bail bonds and surety bonds of petitioner was rejected vide impugned order.

Since the petitioner is ready to furnish bonds and undertakes to appear before the trial Court on each and every date and given the facts above, impugned order is set aside. Petitioner is directed to furnish bail bonds till 20.12.2024. Petitioner's arrest shall remain stayed till 20.12.2024. It is clarified that if the petitioner fails to furnish bail bonds by the date given, this order shall stand recalled automatically without any further reference to this Court. Petition is allowed. Pending applications, if any, stand disposed of.
