Sukhpreet Kaur v. State Of Punjab And Others
CWP No. 2582 of 2019
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 2582 of 2019 Date of decision : 13.03.2019 Sukhpreet Kaur ....Petitioner V/s State of Punjab & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. G.S. Saini, Advocate for the petitioner.
RAJAN GUPTA J.
Notice of motion.
On the asking of court, Ms. Anu Chatrath, Addl. A.G. Punjab, who is present in court, accepts notice on behalf of official respondent(s). Petitioner is seeking a writ of mandamus to direct the respondents to consider her case for appointment pursuant to advertisements (Annexure P-2 or P-4) as she claims to have cleared the Teachers Eligibility Test as per the revised result.
Admittedly some appointments were made on the basis of result declared earlier. An anomalous situation has arisen as to the entitlement of the petitioner for appointment on the basis of revised result and the right of the persons, appointed on the basis of earlier result, to continue in service. A query has been put to State counsel whether a committee of senior officers headed by the Chief Secretary can consider the entire issue and take a just and fair decision under the circumstances. She submits that there is no impediment in such an exercise.
