ANIL KSHETARPAL, J (Oral) Learned counsel for respondent no.4 has pointed out that the suit has already been decided vide judgment dated 23.01.2018. He has placed on file a photocopy of the judgment passed by the learned Additional Civil Judge (Sr. Dvision), Ambala.

The present petition was filed against the order declining the application under Order 6 Rule 17 of the Code of Civil Procedure, seeking permission to amend the plaint. Since the suit itself has been decided, the present revision petition has become infructuous. Dismissed as such.

However, the petitioner would be at liberty to challenge the order passed on 22.12.2017 before the learned first appellate Court while challenging the judgment passed by the learned trial Court.
