(ORAL) The petitioner, through the instant petition under Section 482 Cr.P.C., is seeking direction to official respondents to decide representations dated 28.12.2022 (Annexure P-2) and 10.01.2023 (Annexure P-3) submitted by him and declare him innocent. Learned counsel for the petitioner inter alia contends that FIR No. 255 dated 04.11.2022 under Section 376 IPC and Section 4 of POCSO Act has been registered against the petitioner. There is false implication and he is an innocent person.
Notice of motion, Mr. Amish Sharma, AAG, Punjab accepts notice on behalf of the respondent-State.
Learned State counsel submits that petitioner is involved in the commission of heinous offence and he is not coming forward to join PARAMJIT KAUR SAINI 2023.02.16 18:01 I attest to the accuracy and authenticity of this order/judgment
CRM-M-5421 of 2023 -2investigation. Police is regularly conducting raids at his hideouts still he has not been apprehended.
I have heard counsel for the parties and perused the records.
The police has every right to investigate the matter. The investigation falls within realm of investigating agency and Court has no power to interfere in the investigation. The Court is sanguine of the fact that investigating officer would look into stand of the petitioner and thereafter take appropriate action in accordance with law. No further order is warranted.
Disposed of.
