Challenge in the present appeal is to the judgment/order dated 11.06.2005, passed by the learned Special Court, Hoshiarpur, whereby appellant was convicted and sentenced as under:

Offence u/s Imprisonment Fine Default sentence 15/61/85 of NDPS Act RI for six months Rs.500/- RI for one month 2.

Learned State counsel has produced the statement of Sewakaur and lambardar of the village. The same is taken on record. He on instructions from ASI Karnail Singh submits that the appellant was working as a Sewadar in the house of Sewakaur, whose statement has been recorded along with the Lambardar by the concerned IO on 20.11.2023 to the effect that the appellant has since expired long ago during the pendency of the present appeal. 3.
