ANIL KSHETARPAL, J (Oral) Plaint was rejected under Order 7 rule 11 of the Code of Civil Procedure. First appeal was preferred, which was entertained and the Court has passed an interim order.

It is the case of the petitioner that the jurisdiction of the Civil Court is barred under Section 34 of the the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

Learned trial Court has found as a matter of fact that the jurisdiction of the Civil Court is barred.

Taking into consideration the facts available on the file, it is considered more appropriate to direct the first appellate Court to dispose of the first appeal within a period of two months from the date of receipt of a certified copy of this order.
