AMIT RAWAL J. (Oral) The petitioner-defendant is in revision petition against the impugned order dated 16.09.2017 (Annexure P-3) vide which the application filed under Order 9 Rule 13 CPC has been dismissed by the trial Court. However, the impugned order is appealable as per the provisions of Order 43 Rule 1(d) CPC.

At this stage, learned counsel for the petitioner submitted that he may be allowed to withdraw the present revision petition with liberty to avail the remedy, in accordance with law.
