(Oral) The prayer in the present petition under Section 528 of BNSS of 2023, is for issuance of directions to respondent Nos.2 and 3 for transfer of the investigation of FIR No. 146 dated 16.08.2024 under Sections 108, 190 of BNS, Police Station City Sri Muktsar Sahib (Annexure P-5) from respondent Nos. 4 to 5 to the Crime Branch/Special Crime Unit or to any Senior Officer not below the rank of Inspector General of Police. The counsel for the petitioner contends that the deceased, namely, Surjit Singh was a witness to a Will executed by Jasvir Singh in favour of the petitioner. The private respondents were threatening him not to depose in support of the Will and because of the pressure, he committed suicide. Now, the private respondents and the wife of the deceased have effected a compromise because of which a cancellation report has been submitted.

In view of the above, the present petition is disposed of with the directions to the Trial Court to summon the petitioner and record her statement as well prior to adjudicating upon the said cancellation report.
