(Oral) This petition has been filed, inter alia, seeking a writ of mandamus directing the respondents to allow the petitioner to continue working on deputation in Government Primary School, Molahera, District Gurugram.

Learned counsel contends that looking into the family circumstances of the petitioner, who was posted as Primary Teacher (PRT) in Government Primary School, Sandhai, Yamuna Nagar, she was sent on deputation to Government Primary School, Molahera, Gurugram, for one hundred eighty days vide order dated 08.08.2023; this period is to expire on 06.02.2024. In the meanwhile, pursuant to Permanent District Allotment Drive, the petitioner has been allocated district Gurugram, as is apparent from the communication, Annexure P-14. However, permanent posting of teachers PAYAL 2024.02.02 18:12 I attest to the accuracy and authenticity of this order/judgment

Therefore, the apprehension is that the petitioner will be asked to join back at Yamuna Nagar, on expiry of the deputation period. He has relied upon an earlier order passed by this Court in CWP-5942-2019 titled Asha v. State of Haryana and others, wherein in the similar circumstances the petitioner was allowed to continue working in the school where she was temporarily deputed.

Learned State counsel, appearing on advance notice, does not dispute the facts aforestated.

In view thereof, the petition is disposed of with a direction to the respondents to allow the petitioner to work in Government Primary School, Molahera, District Gurugram, where she was sent on deputation, till her permanent posting order is issued.
