Concededly the suit is at the stage of defence evidence, when the application under Order 7 Rule 11 of CPC, at the instance of the petitioner-defendant was filed. No doubt the application can be moved at any stage of the suit, but it is too late in a day to adjudicate upon the application. The defendant shall complete the evidence as early possible, so that, the suit reaches at the final stage of arguments.
