Raj Shekhar Attri, J (Oral) This is a petition for transfer of case No.MNT-125/28/2018 dated 08.10.2018 titled 'Surbhi Mehta & another vs. Vipul Mehta' pending in the court of Sub Divisional Judicial Magistrate, Sultanpur Lodhi, District Kapurthala to a court of any competent jurisdiction outside District Kapurthala.

It has been argued that father of respondent is a practicing lawyer at Sultanpur Lodhi, District Kapurthala. Earlier also, vide order dated 23.01.2018 passed in Criminal Miscellaneous No.M-26346 of 2016, this Court had transferred a complaint case bearing No.9 dated 12.05.2016 under AVIN KUMAR 2019.04.23 10:47 I attest to the accuracy and integrity of this document

CRM NoM-4378 of 2019 [2] the provisions of Protection of Women from Domestic Violence Act, 2005 titled 'Surbhi Mehta vs. Vipul Mehta & others' to Nakodar, District Jalandhar.

Keeping in view the facts and circumstances of the case, case No.MNT-125/28/2018 dated 08.10.2018 titled 'Surbhi Mehta & another vs. Vipul Mehta' pending in the court of Sub Divisional Judicial Magistrate, Sultanpur Lodhi, District Kapurthala, is transferred to the court of Sub Divisional Judicial Magistrate, Nakodar, District Jalandhar. However, petitioner shall pay an amount of ` 2,000/- for the to & fro journey from Sultanpur Lodhi to Nakodar, to the respondent - wife on her each appearance before the transferee court. It is made clear that this amount shall be separate from the amount of grant of maintenance. Disposed of accordingly.
