The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.09 dated 8.2.2019 at Police Station Mattewal, Amritsar Rural, District Amritsar under Sections 420, 465, 468, 471, 120-B of Indian Penal Code and Section 13 of Punjab Prevention of Smuggling Act, 2012.

The allegations against the petitioner are to the effect that he had induced the complainants Nirmal Singh, Vijay Kumar, Roop Singh, Swaran Singh and Sony to pay an amount of `30,000/- each while representing that he would send them abroad. It is alleged that the accused received the said amount from the complainants but he gave forged VISAs to them and on account of which the complainants had to return back from Delhi Airport. Learned State counsel has informed that the petitioner stands involved in 3 other cases of similar nature and had been declared a proclaimed offender on 15.1.2020.

In view of the aforestated position, wherein the petitioner appears to be a habitual offender and has already been declared a proclaimed offender, this Court does not deem appropriate to extend the benefit of anticipatory bail.
