"&   The plaintiff in a suit for grant of decree of permanent injunction with a prayer to restrain the defendants from alienating, transferring and interfering in his actual and physical possession, is the petitioner herein. His application under Order 1 Rule 10 read with Order 6 Rule 17 of the Code of Civil Procedure has been dismissed by the trial Court. He wants to implead Smt. Asha Rani as a defendant on the ground that she is a subsequent vendee. The plaintiff has already concluded his evidence. The plaintiff can always file a fresh suit against Smt. Asha Rani. The trial Court has correctly held that the present suit is at the advanced stage and therefore, the application is not required to be allowed.

Hence, no ground to interfere is made out.

Dismissed.
