G.S.SANDHAWALIA, J. (Oral) The following order was passed by this Court on 08.02.2017:- "After arguing for some time and keeping in view the fact that there are concurrent findings on the issue of bona fide requirement of the premises in question and since the petitioner is running hair saloon and would take time for relocation and he has been in possession since 2004, counsel prays for time to file affidavit that he would vacate the premises by 31.12.2017 and clear all the arrears and continue paying the rent till the said date by the 7th of each month.
To come up for the said purpose on 17.02.2017." Accordingly, C.M. No. 3494-CII of 2017 for placing on record additional affidavit of the petitioner has been filed, which is allowed, subject to all just exceptions.
The same is taken on record.
Vide the said affidavit, undertaking has been given by the petitioner to vacate the premises by 31.12.2017. Keeping in view the above undertaking, the present revision Shivani Gupta 2017.02.17 17:07 I attest to the accuracy and integrity of this document Chandigarh
-2petition is disposed of. It is, however, made clear that the petitioner will not hand over the possession to anyone else except the landlord, as undertaken. He will also deposit all the arrears of rent and continue paying the rent by the 7th of each month. In case of violation of any of the above said conditions, the landlord will be entitled to take possession before the stipulated date. In case the vacation is not done by the stipulated date, the Rent Controller will get the possession handed over to the landlord with the help of police, if required.
