(Oral) Petitioner is seeking directions to the respondents to quash order dated 27.03.1996 (Annexure P-4) and to appoint him as Dental Surgeon Class-II from the date he was entitled for appointment. Petitioner was participated in the selection process for appointment as Dental Surgeon Class-II. The name of the petitioner was appeared at Serial No.18 in the merit list and he had received a letter dated 16.09.1994 (Annexure P-1) to this effect from the Secretary, Haryana Public Service Commission, Chandigarh.
Thereafter, the appointment to the petitioner was denied on the ground of pendency of a criminal case registered against him under Sections 302 and 498-A read with Section 120-B IPC. CWP No. 11493 of 1996 -2decided, vide order dated 27.03.1996 (Annexure P-4) by the Financial Commissioner & Secretary to Govt., Haryana, Health Department. Perusal of order dated 27.03.1996 (Annexure P-4) shows that the petitioner was involved in a criminal case registered under Sections 302 and 498-A read with Section 120-B IPC and challan has been filed in the Court on 21.11.1994.
Keeping in view the above facts, the respondent department has rightly rejected the claim of the petitioner and the present writ petition is dismissed as such.
