Prayer in this appeal is for setting-aside judgment dated 16.01.2025 passed by learned Single Judge in CWP No.1580 of 2020 titled as 'Surender Lather Vs. State of Haryana and another', whereby writ petition filed by the appellant was dismissed. 2.

Arguments in the appeal were heard on 18.03.2025 and judgment reserved. However, difference of opinion had arisen between Members of the Bench, who heard the matter on 18.03.2025 and reserved the same. Divergent opinions were pronounced on 29.05.2025. LPA No.290 of 2025 (O&M) -2Judges (Sanjeev Prakash Sharma, J.) allowed the appeal whereas the other Judge (Meenakshi I. Mehta, J.) found no merit in the appeal and dismissed the same. Subsequent thereto, matter was referred for opinion of the third Judge. Vide detailed decision dated 31.07.2025, learned third Judge (Vikas Bahl, J.) has concurred with the view expressed by Justice Sanjeev Prakash Sharma, whereby appeal has been allowed.

Present appeal is, accordingly, allowed in terms of the majority view.
