This appeal has been filed by appellant- Kuldip Singh, against the judgment of conviction and order of sentence dated 31.07.2006 passed by learned Judge, Additional Sessions Judge (Adhoc), Fast Track Court, Muktsar, passed in Sessions Case No. 155 dated 17.11.2005/12.03.2003, arising out of FIR No. 1 dated 06.01.2003, under Section 489-C of the Indian Penal Code, registered at Police Station City Malout. 2.

Learned counsel for the appellant submtis that as a matter of fact, appellant-Kuldip Singh has expired during the pendency of present appeal before this Court, therefore, present appeal stands abated. 3.

On the other hand, Mr. Anmol Singh Sandhu, AAG, Punjab, is unable to counter the factum of death of appellant- Kuldip Singh, as disclosed by learned counsel for the appellant. 4.

In view of the above, present appeal i.e.

CRA-S-1643-SB2006 stands abated qua the appellant- Kuldip Singh, subject to the conditions laid down in the case of "Shivji Ram @ Dimple Vs.
