This petition had come up for hearing yesterday. However, Mr. Rohit Bedi, Advocate, who has filed this petition, was not present. Petitioner no. 1(i) was present in person. Learned counsel for respondent no. 1 - plaintiff had submitted that his client's suit had been decreed by the Trial Court on 27.08.2019 rendering the present petition infructuous. Petitioner no. 1(i), who is an old widow, requested for an adjournment to enable her counsel to appear on her behalf. On her request, the matter was adjourned for today and was ordered to be taken up in the urgent list. Even today, only petitioner no. 1(i) is present in person. She submitted that she had informed Mr. Rohit Bedi, Advocate with regard to MONIKA 2019.09.26 13:28 I attest to the accuracy and integrity of this document
C. R. No. 1648 of 2019 the listing of this case for today. The Reader of this Court had also informed Mr. Rohit Bedi, Advocate that this case would be taken up today in the urgent list. In spite of the same, in a highly irresponsible manner, Mr. Bedi is not present.
After hearing petitioner no. 1(i) and learned counsel for respondent no. 1, the admitted position that has emerged is that respondent no.1's suit has been decreed by the Trial Court on 27.08.2019 and now, the remedy available to the petitioners is to challenge such decree by way of an appeal. Accordingly, the present petition is disposed of as having been rendered infructuous with liberty to the petitioners to challenge the aforesaid decree by way of an appeal, if so advised. It is clarified that the petitioners shall be at liberty to raise all pleas raised by them in the present petition in their appeal, if any, to be filed by them.
