Tribhuvan Dahiya, J (Oral) This is a revision petition under Article 227 of the Constitution of India for setting aside order dated 12.12.2019 (Annexure P-4) dismissing the application filed by the petitioners - plaintiffs for leading additional evidence by producing report of inquiry conducted by SMO, Budhlada, regarding death of Wariyam Singh, and entry regarding his last rites from record of Ganga Ram Prohit and allowing them to exhibit these documents on record.

Issues in the suit were framed on 03.11.2018 and plaintiffs led their evidence. They closed their oral evidence on 16.07.2019 and documentary evidence on 25.07.2019. Thereafter, defendants closed their evidence on 18.11.2019. As on 17.01.2020, the case was pending for rebuttal evidence. It was at that time, the present application for adducing additional evidence was filed.

CR No.1051 of 2020 [2] Learned counsel for the petitioners has not been able to show any plausible reason as to why the documentary evidence could not be adduced at the time of leading evidence in the affirmative. It is his own case that one of the documents sought to be proved on record by way of additional evidence, i.e., copy of record of Ganga Ram Prohit is already on record as Mark A. Inquiry report of SMO is dated 02.02.2016 and the petitioners - plaintiffs' evidence was closed after that on25.07.2019. In this view of the matter, no ground to interfere with the impugned order is made out.

Dismissed.
