HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.249 dated 10.12.2021 under Sections 363,365,120-B,454 IPC registered at P.S Dasuya, District Hoshiarpur.

FIR was registered on the statement of Sukhwinder Kaur, who stated that a matrimonial dispute was going on between her son Amrit Pal Singh and daughter-in-law Harmeet Kaur. It is alleged that on 10.12.2021, Harmeet Kaur along with various other persons came in a car and forcibly took away Balnoor Singh grand-son of the complainant. The incident was captured in CCTV camera. Allegation against the petitioner is that the child was recovered from the house of the petitioner. Learned counsel for the petitioner submits that the present case is outcome of matrimonial dispute. Harmeet Kaur, mother of the child, who was alleged to have forcibly taken away the child with the help of others has already been granted bail vide order dated 18.01.2022 passed by this Court in CRM-M-1588 of 2022. CRM-M-5782 of 2022 #2# has been handed over to his father. Investigation is complete and that the petitioner has been in custody since 16.12.2021. Without commenting anything on the merits of the case and also bearing in mind the facts of this case besides the fact that the trial is not likely to conclude in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Vijay Kumar is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
