RITU BAHRI, J.(Oral) Petitioner is seeking issuance of directions to the respondents to consider her eligible for promotion to the post of TGT English and promote her as TGT English w.e.f the date from which other persons including juniors have been promoted with all consequential benefits.

Learned counsel for the petitioner at the very outset has referred to judgment dated 12.09.2018 (P-9) titled as Suresh Chander and others vs. State of Haryana etc in which this Court held that the condition mentioned in clause (ii) regarding B.Ed with relevant subject is not applicable where the candidate was appointed in the feeder cadre on the basis of B.Ed qualification. Learned counsel for the petitioner submits that no LPA has been filed against judgment dated 12.09.2018 by the respondent-department till date. In this regard, petitioner has given demand notice dated 23.12.2019 (P-10) but no action has been taken till date. Issue notice of motion.

On asking of the Court, Mr. Kiran Pal Singh, AAG, Haryana accepts notice on behalf of the respondent-State.

Without commenting upon merits of the case, this petition at this stage is being disposed of by giving direction to the respondent No. 2 to decide the demand notice dated 23.12.2019 (P-10) and pass appropriate orders, in accordance with law, within a period of three months from the date of receipt of certified copy of this order.
