As common issues are involved in the captioned petitions, with the consent of both sides, the same are hereby disposed of by this common order. For the sake of brevity and convenience, facts are borrowed from CWP-2351-2026.

The petitioners are seeking direction to respondent to supply electricity to their residential houses located at Village Kansal, Mohali. 3.

The petitioners are residents of Village Kansal, Mohali. They have constructed their houses many years back. They are not having electricity connection. They are claiming that electricity connection is part of fundamental right guaranteed by Article 21 of Constitution of India. The respondent should be directed to extend them benefit of electricity supply.

Mr. Samay Sandhawalia, Advocate has filed Power of Attorney on behalf of respondent-Punjab State Power Corporation Limited (for short 'PSPCL') The same is taken on record. Registry is directed to tag the same at an appropriate place. 5.

Learned counsel for the respondents-PSPCL submit that PSPCL is not averse to prayer of the petitioners, however, on account of interim orders passed by this Court, is helpless and cannot start electricity supply. A Division Bench of this Court vide order dated 18.12.2020 passed in RA-CW-252-2020 in CWP-18253-2009 directed all the authorities not to grant any permission for construction, water, electricity or sewerage connection to any dwelling unit. The said order was modified vide order dated 29.09.2021. As per order dated 29.09.2021, the authorities were supposed to submit report of repair/maintenance work undertaken by them. The respondent has filed CM-3571-2026 in CWP18253-2009 seeking permission to grant temporary connections to residents of Kansal during the pendency of main petition. The matter is listed before First Division Bench on 20.03.2026. It cannot supply electricity without orders of Division Bench of this Court.

Learned counsel for the petitioners do not dispute aforesaid factual and legal position.

From the perusal of record, it is evident that respondent corporation is not opposing prayer of the petitioners, however, in view of interim orders passed by Division Bench of this Court is expressing its helplessness. It has already approached Division Bench seeking permission to grant temporary connections to the petitioners. Thus, its stand is justified.

In the wake of pendency of matter before Division Bench, this Court cannot issue any direction to respondents. Accordingly, petitions stand disposed of. The disposal of instant petitions would not inhibit the petitioners to avail alternative remedies. They may also approach this Court at an appropriate stage.
