CORAM:HON'BLE MR. JUSTICE AMIT RAWAL

Present:

Mr. Parveen K. Kataria, Advocate for the petitioner.

Mr. Suvir Kumar, Advocate for respondent No.1 and 2.

Mr. Sandeep Mann, AAG, Punjab.

-.- AMIT RAWAL J. (ORAL) The revision petition is directed against the impugned order dated 25.09.2015 whereby the execution application submitted by the petitioner on receipt of compensation awarded by the Courts below, has been consigned to the record room having been satisfied. The sole contention raised in the present revision petition is that while making the payment, the respondent could not have deducted TDS of 20% i.e. `2,46,232/-.

I am afraid aforementioned argument of Mr. Kataria is not sustainable, for, the petitioner is at liberty to make mention of the same in the income tax return and claim benefit in accordance with law. With the aforementioned observations, while upholding the order under challenge, the revision petition stands disposed of.
