ARUN MONGA, J. (ORAL) The grievance of the petitioner is qua inaction of the official respondents in processing disbursements, of what is claimed to be his admitted dues, in respect of the work carried out by him. 2.

Learned counsel inter alia contends that despite satisfactory inspection of work executed by the petitioner and thereafter having issued a completion certificate/report, contained at Annexure P-3, for no justifiable reasons, the payment qua the same not being remitted. Petitioner also submitted a representation dated 29.07.2020 (Annexure P-5) but the same has not been adverted by the respondents till date. Hence, the instant petition.

State is duty bound to respond to a legal notice/representation where it is alleged that the amounts are admittedly due/verified. The same would save the litigants from avoidable litigation to seek indulgence of court, merely to get response on a pending legal notice/representation. In the premise, without adverting to merits of the case, the instant petition is disposed of with a direction to competent authority, to take a decision, either way, on pending representation, by passing speaking order, in accordance with law, within a period of six weeks from the date of receipt of copy of this order.

In case favourable order is passed, benefit thereof be accorded within a period of six weeks thereafter, failing which, petitioner shall be entitled to interest @ 9% p.a., recoverable from the salary of the erring official.
