Mr. Vivek Singla, Advocate for Mr. Vivek Salathia, Advocate for the respondent. AMIT RAWAL, J (ORAL) Present revision petition is directed against order dated 02.1.2017 vide which learned Addl. District Judge, Rup Nagar while disposing of the application filed by the respondent-wife under Section 24 of the Hindu Marriage Act ordered a sum of Rs.10,000/- per month to be paid by the petitioner-husband to the respondent-wife towards interim maintenance besides a sum of Rs.20,000/- as litigation expenses. Learned counsel for the petitioner submitted that the respondent-wife has already been granted maintenance in proceedings under Sections 125 Cr.P.C as well as in the complaint filed under the Protection of Women from Domestic Violence Act to the tune of Rs.4,000/- and Rs.3000/- respectively. The income of the petitioner-husband is only Rs.
24000/-. He submitted that the respondent-wife is only entitled to interim maintenance in one of the proceedings and not in all. Per contra, learned counsel for the respondent has not disputed MANOJ KUMAR 2018.12.
C.R.No.972 of 2017 #2# the fact of interim maintenance being granted in other proceedings. He however submitted that two children are also living with the respondentwife, therefore, maintenance of Rs.10,000/- is on lower side. After hearing learned counsel for the parties and taking into account the fact that the children are living with the respondent-wife, sum of Rs.10,000/- granted to the respondent-wife as interim maintenance seems to be fair and justifiable.
Accordingly, this petition is disposed with the observations that the interim maintenance shall be awarded to the respondent-wife in one of the proceedings only after adjustment.
