(ORAL) By way of present petition filed under Section 438 CrPC, prayer has been made for grant of anticipatory bail in FIR No. 117 dated 16.12.2023 registered under Sections 323, 452 and 34 of IPC (Section 325 of IPC added later on) at P.S. Garhdiwala, District Hoshiarpur. Learned State counsel as well as learned counsel representing complainant submits that petitioner has been declared as proclaimed person in complaint case No.NACT/145/2016. As such, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file fresh one after assailing the order dated 31.05.2018 whereby, the petitioner has been declared as proclaimed offender.
