MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of regular bail in FIR No.15 dated 20.12.2019 under Sections 21, 25, 29 of the NDPS Act, 1985, registered at Police Station State Special Operation Cell, Amritsar.

Learned counsel for the petitioner submits that even though the petitioner was arrested in the present case on 20.12.2019, however, the trial has not concluded as the prosecution evidence is still underway. It has been, therefore, prayed that in the circumstances, the constitutional right of the petitioner to a speedy and fair trial has been severely compromised, and, therefore, he deserves to be extended the concession of bail. 3.

CRM-M-5695-2025 (O&M) -2by the counsel for the petitioner with respect to the stage of the trial and has instead brought to the notice of this Court that prosecution evidence concluded way back on 06.02.2024. However, from the last more than one year, it is the defence, which is responsible for delaying the trial; the defence counsel has been taking repeated adjournments before the trial Court. 4.

After arguing for some time, when this Court was not inclined in view of the instructions received by the learned State counsel, a prayer was made by the learned counsel for the petitioner for withdrawal of the instant petition. 5.

Dismissed as withdrawn.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
