Challenge in the present petition is to order dated 20.01.2026 passed by the learned Judge, Special Court, Moga, vide which the application for extension of interim bail on medical grounds filed by the petitioner, accused in case FIR No.63 dated 28.03.2025 u/s 22 and 29 of the NDPS Act, was dismissed.

Learned counsel for the petitioner contends that petitioner, who has been falsely implicated in the present case, has been suffering from serious medical ailments. She had undergone IVF treatment and had also undergone surgery on 17.01.2026 at Sukh Seva Multispeciality Hospital, Kharar, wherein she remained hospitalized for few days. When her condition was little stable, she was discharged on 26.01.2026. It is thus the submission of learned counsel that on account of medical exigency, petitioner could not put in appearance before the Court concerned and that her absence before the learned trial Court was not intentional but was on account of circumstances mentioned hereinabove. Learned counsel further contends that petitioner is willing to surrender before the concerned Court within a period of 10 days, her only HAMANT 2026.02.24 11:20 I attest to the accuracy and integrity of this document

In the light of the aforesaid submissions and facts having been brought on record, without adverting to the merits of the case, the present petition is disposed of with a direction to the petitioner to appear before the concerned Court within a period of 10 days and move an application for grant of bail.
