1. Today, at the very outset, learned counsel for the petitioner submitted that he may be permitted to withdraw the present petition with liberty to raise all the pleas as have been raised herein before the Trial Court at appropriate stage and also with liberty to lead all such evidence as may be available with the petitioner to establish his innocence including electronic/digital evidence in the shape of CCTV footage/video recording/mobile recording.

2. In view of the aforesaid submission, the instant petition is dismissed as withdrawn with liberty aforesaid.

3. It is clarified that the Trial Court shall duly consider any such application as may be made by the petitioner for leading evidence in his defence including electronic/digital evidence in the shape of CCTV footage/video recording/mobile recording and shall consider admissibility of the same in Pankaj Kakkar 2024.02.08 16:20 I attest to the accuracy and authenticity of this document
