*** SANDEEP MOUDGIL, J. (ORAL) The jurisdiction of this Court under Section 438 Cr.P.C., has been invoked for the grant of anticipatory bail to the petitioner in case FIR No. 155, dated 02.11.2023, under Sections 452, 307, 336, 427, 148, 149 and 120-B IPC and Sections 25 and 27 of Arms Act, 1959, registered at Police Station Jhabal, District Tarn Taran.

Learned counsel for the petitioner submits that in pursuance to the order dated 01.02.2024, the petitioner has joined investigation. This very fact is not controverted by learned State counsel who, on instructions from HC Satnam Singh, submits that the petitioner is not required for custodial interrogation as nothing is to be recovered from him. Accordingly, the present petition is allowed and the interim order dated 01.02.2024 is made absolute. However, the petitioner shall continue to join investigation as and when required to do so and shall abide by the terms and conditions, as laid down under Section 438 (2) Cr.P.C.
