This is second petition under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.33/2019 dated 20.08.2019 registered for the offences punishable under Sections 21, 22, 29 of Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Nangal Bhoor, District Pathankot. Learned counsel for the petitioner submits that police intends to arrest the petitioner on the basis of disclosure statement of co-accused, which is not admissible and there is no other evidence against the petitioner about his involvement in the drug trafficking. The above plea of the petitioner was considered while passing order dated 13.12.2019. No new fact has been disclosed, which gives rise to the petitioner to file second application for pre-arrest bail. CRM-M-4507-2020 -2Keeping in view the above facts and circumstance, I do not find any reason to exercise the discretionary power of this Court to extend the benefit of anticipatory bail to the petitioner. This petition has no merits. Dismissed.
