(ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in case FIR No.21 dated 21.02.2023 registered under Sections 307, 324, 323, 148 and 149 of the IPC (Section 326 of the IPC added later on) at Police Station Cantt Ferozepur.

Learned State counsel has filed an affidavit of Deputy Superintendent of Police, Ferozepur, which is taken on record subject to just exceptions.

Learned State counsel while drawing the attention of this Court to the affidavit has submitted that a perusal of the annexures clearly reveals that proceedings under Section 82 of the Cr.P.C. have since been initiated against the petitioner.

In the circumstances, once proceedings under Section 82 of the Cr.P.C. have been initiated against the petitioner, this Court would not be inclined to extend the extraordinary concession of anticipatory bail to him.

The instant petition stands dismissed.
