The petitioner incarcerated in the FIR captioned above had come up before this Court under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, [BNSS], seeking regular bail.

 Custody certificate filed by State counsel in Court today is taken on record. Copy thereof has been supplied to the counsel for the petitioner. 3.

In per note 2 of the petition, the petitioner has mentioned that there is no other FIR is pending against him. However, State counsel submits that as per custody certificate dated 01.02.2025, there are five other cases have been registered against the petitioner.

Faced with this situation, counsel for the petitioner wants to withdraw the present petition with liberty to file fresh one after disclosing all criminal antecedents. He further prayed for permission to file fresh petition without filing fresh power of attorney.

Given above, the present petition stands disposed of having been withdrawn with liberty aforesaid. Since, the petitioner has already given power of attorney to his counsel in this petition, as such, Registry shall not insist to file power of attorney in case fresh petition is filed and power of attorney filed in this petition shall suffice.
