The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.0212 dated 24.12.2020 at Police Station Civil Lines, Bathinda under Sections 379-B and 34 of Indian Penal Code, wherein the allegations are broadly to the effect that the accused had snatched a mobile phone from the complainant. 2.

The learned counsel for the petitioner has submitted the petitioner has falsely been implicated in the present case and that, in any case, since the challan already stands presented, no useful purpose would be served by detaining him behind bars.

Opposing the petition, the learned State counsel has submitted that since the petitioner was arrested at the spot, his complicity in the matter is clearly evident and that he does not deserve the concession of bail. The learned State counsel has, however, informed that the petitioner has been behind bars since the last more than 3 months and that challan already stands presented and that he is not involved in any other case.

Having regard to the aforestated position, wherein the only allegation pertains to snatching of a mobile phone and the petitioner is not stated to be involved in any other case and has been behind bars since the last more than 3 months and challan stands presented, further detention of the petitioner will not serve any useful. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
