RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for setting aside the order dated 11.09.2018, Annexure P-1, passed by respondents No.2 and 3 whereby the objections filed by the petitioners have been dismissed and the scheme has been accepted and forwarded to the concerned officer for further proceedings, wrongly and illegally.

Learned counsel for the petitioners submits that as the scheme was not published hence, as per the provisions of Section 18(2) of the Haryana Canal and Drainage Act, the petitioners did not have the right of filing appeal before the Superintending Canal Officer. He further submits that thereafter the petitioners filed an application before the learned Financial Commissioner, which is appended as Annexure P-3, however, no decision has been taken on the same till date. Learned State counsel though has opposed the submissions made by learned counsel for the petitioners, however, he submits that a MEENU 2024.05.15 13:57 I attest to the accuracy and integrity of this document

CWP-2797-2020 -2speaking order would be passed by the learned Financial Commissioner on the application filed by them.

In view of the submissions made by learned State counsel, the present petition is disposed of with a direction to respondent No.1-Financial Commissioner to pass a speaking order on the application filed by the petitioners after hearing all the concerned parties expeditiously in accordance with law preferably within eight weeks from today.
